FOR THE PURCHASE OF THE FACILITIES OF

LIBURNIA RIVIERA HOTELI d.d., Opatija

(May 2001)

 

1. SCOPE OF THE PURCHASE

 

Liburnia Riviera Hoteli d.d., Opatija (hereinafter referred to as LRH) hereby invites local and foreign natural and legal persons to submit their bids for the purchase of the facilities specified below.

 

Excluded from the right to bid are the legal and natural persons as well as the founders and officers of the legal persons against which LRH has disputable or unsettled claims on whatever basis as of May 28, 2001.

Villa Frappart is covered by a Lease Agreement till 15.09.2001, and the Lessee is the company Rimi Co d.o.o. of Lovran.

 

The Croatian Bank for Reconstruction and Development, Zagreb is a 100% owner and the property right has been officially transferred from LRH on account of a security for the claim in the amount of 10,000,000.00 kn.

 

The land register data related to the subject real property are described in more detail in the Bidding Documents.

 

N o t e: The price shall be calculated based on the mean exchange rate applied by the Riječka banka d.d. on the date of payment.

 

2. BIDDING DOCUMENTS

 

The bidding procedure and the selection of the best Bidder shall be in accordance with the terms and conditions laid down in the Bidding Documents. The Bidding Documents will be available to Bidders at LRH d.d., Opatija on 16th, 18th, 21st and 23rd May 2001.

 

 

The costs of the Bidding Documents, amounting to 700.00 kunas, shall be paid to the LRH’s direct transfer account No. 33880-601-11513 with ZAP (National Audit Office), Opatija, with reference to the No. 02 130501.

 

3. Preference will be given to those Bidders whose development programs contribute to the upgrading of the total tourist offer of the Liburnian riviera.

 

4. BIDDING TERMS AND CONDITIONS

 

The Bids shall be submitted in accordance with the terms and conditions laid down in the Bidding Documents.

 

Foreign natural and legal persons may, on a reciprocity basis, acquire real property in the territory of the Republic of Croatia, subject to the approval of the Foreign Minister of the Republic of Croatia, issued after having previously obtained the opinion of the Minister of Justice of the Republic of Croatia.

 

Bid Security:

 

The Bidders shall pay a Bid Security in kunas, amounting to fifteen percent (15%) of the initial Sales Price, to the LRH’s direct transfer account No. 33880-601-11513 with ZAP (National Audit Office), Opatija, with reference to the No. 02 270501 i.e., in case of foreign natural and legal persons, an equivalent amount in DEM to the LRH’s foreign currency account No. 33880-621-84-25000 with the Riječka banka Rijeka, Opatija Branch, and shall include a copy of the payment document in their Bid.

 

The Bids shall be submitted to LRH in a sealed envelope duly marked as BID FOR THE PURCHASE OF THE FACILITY OF THE JOINT STOCK COMPANY LRH – May 2001 (specify the name of the facility).

 

The Bids shall be submitted to LRH by 13.00 h on May 31st 2001 (Thursday) at the latest.

 

Any further information will be available from 11 – 13 h each working day at the phone No. 710-322.

 

The inspection of the facilities will be possible on 18th, 21st, 23rd and 25th May 2001 from 9.00 to 12.00 h against presentation of the Power of Attorney included in the Bidding Document.

 

The received Bids will be opened at Liburnia Riviera Hoteli d.d. Opatija, Hotel Admiral, Maršala Tita 139 at 13.30 h on May 31, 2001. The Bidders or their authorized representatives may be present at the Bid opening.

 

LRH retains the right either to accept any responsive Bid or to refuse any Bid or to cancel the Bidding procedure and refuse all Bids, without any liability whatsoever.
